BORDEAUX - SHANGHAI RALLY 2006
BOOKING CONDITIONS
Decree N°94-490 of the 15th June 1994 in application to the section of the law N°92-645 of the 13th July 1992, covers general conditions, These are common conditions to all travel agencies.
These cover the conditions under which the D.B.E Rallies are organized, in collaboration with L'ENVOL travel agency - Mister Gérard PINTO, Licence N°075 02 0023 (APS guarantee)
D.B.E is an organization managed by Brice PREVOST. Its aim is to organise events
and rallies for 4X4 vehicles. These rallies are open to everyone over 18 years
of age. Those under 18 are accepted under the entire responsibility of an accompanying
adult (with parental consent).
Drivers must have a French or British driving licence, and an international
driving licence, corresponding to the driven Vehicle.
The Vehicle must conform to the Driving Code and must be licensed and insured.
Its preparation and equipment must conform to the ‘Contractual Conditions’ as
defined by the Technical Direction of the Organization. (See ‘Vehicle Equipment’ list)
With regard to the difficulty of some routes, the Organisation reserves the right
to refuse entry to persons and/or vehicles that appear unfit for the Rally. Each
Participant must understand and accept the risks of this kind of trip and note
in particular the distance they will be from medical centres. Each Participant
must assume these risks for any incident or illness that could occur and its
consequences.
Moreover, the Participant indemnifies the Organisation and its members; he/she also declares all lawsuits null and void to any claimants. The Organization cannot be liable for incidents or damages occurring to any Participant or Vehicle.
Each Participant undertakes to respect the laws and customs of the
country they are travelling in; the Organisation cannot, in any way,
be liable for any offences committed by a Participant.
The Organization reserves the right to exclude any Participant or group of
Participants who knowingly commit/s an offence against local law or who, for
whatever reason, jeopardise/s the safe continuation of the Rally.
The Participant or group of Participants thus excluded would no longer be allowed to continue on the Rally and the Organization would no longer have any liabilities or responsibilities towards them, including that of giving assistance.
In the event of exclusion, the Organisation will have no obligation to refund any monies paid or pay any damages to the Participant or group of Participants excluded.
Programme:
For political, climatic or sanitary reasons, the Organization reserves the right to delay, modify or cancel an event, entertainment or hotel from the programme. In such an event, Participants will have no recourse to any refund or damages claim. However, the Organisation undertakes to make every reasonable effort to keep the Rally to its original programme.Reservation for a booking will only be accepted after the deposit of 30% has
been received.
- The deposit is 30% of the full price
- The deposit must be received at least two months before the departure date
- The balance is payable 30 days before the departure date
Each Participant must have his own repatriation insurance. Each Participant must
supply the Organisation with a photocopy of their insurance contract mentioning
the insured persons/’ name/s, the name of the insurance company, and the
number of the contract, the expiry date and the 24-hour emergency telephone number.
The Organisation draws your attention to the fact that, in accordance with the
countries concerned, there are different guarantees by law or by rule depending
on the service providers. We recommend that you consult your insurance company
about supplementary cover.
N.B. beyond Europe (Ural), insurance companies do not generally
cover vehicle repatriation.
The Organization reserves the right to cancel the Rally
up to the departure date. Rallies with less than 12 vehicles will be
cancelled at least 45 days before the departure date. However, the Rally
may continue if all the Participants agree to pay the additional costs
involved. In the event of cancellation, the Organisation will not be
liable for any damages or payments other than the refund of monies already
paid.
Cancellation of a booking must be received in writing by recorded delivery.
Participants are strongly advised to take out cancellation insurance inclusive
of a clause to repay all costs in the event of the Rally being cancelled or abandoned.
A claim must be sent to the cancellation insurance company within 24 hours.
For any cancellation, for whatever reason, the following monies will be retained
by the Organisation
- More than 30 days before departure: 1.000€ per person (to cover administration
costs)
- From 30 to 21 days before departure: 25% of the total amount
- From 20 to 8 days before departure: 50% of the total amount
- From 7 to 2 days before departure: 90% of the total amount
- Less than 2 days before departure: 100% of the total amount
- In the event of the Participant not turning up on the departure date: 100%
of the total amount
- In the event of the Participant leaving the Rally at any time during it’s
course there will be no reimbursement.
The Organisation will take care of all visa formalities. N.B. Passports
must be valid for at least 6 months and 1 day from the day of your RETURN; Passports
must also be made available to the Organisation during the Rally.
By signing the booking contract Participants are accepting fully and in its entirety
the booking conditions. Participants are also agreeing unconditionally to adhere
to the Booking Conditions.
The booking contract is valid from the day that the deposit is received.
Any complaint relating to the Rally must be made, as soon as possible, to the
Directors of BORDEAUX-SHANGHAI so that steps can be taken to rectify the matter.
If it is not, everything relating to the Rally will be considered to be entirely
satisfactory to the Participant. Any suit born out of holiday sales contracts
will be invalid after a delay of 6 months from the finishing date of the Rally.
If the Rally does not occur, the 6 months delay will start from the stated finishing
date at the time of booking.
In the event of cancellation, the 6 months delay will run from the date of cancellation
or, at the latest, from the planned start date of the rally. The jurisdiction
would come under the Law Court of Paris.
Reproductions of any BORDEAUX-SHANGHAI images or its identity (Logos, photos,
brochures etc.) cannot be used without an official authorization from BORDEAUX-
SHANGHAI.
The current website, and its advertised content, is not a contractual document
according to the decree of 14th June 1982.
